What the policy protects

For organisations operating hazardous facilities

The insured obligation is to compensate harm caused to other persons and to the environment in the event of an accident at a hazardous production facility.

Life and health of people

Covers harm to the life and health of people injured in an accident at the facility — except the policyholder's own employees.

Property of other persons

Compensates damage to buildings, equipment and vehicles of neighbouring businesses and residents affected by the accident.

The environment

Coverage includes pollution of land, subsoil, surface water and groundwater caused by the accident.

Loss mitigation costs

Reimburses the policyholder's necessary costs of containing the consequences of an accident — up to 20% above the sum insured.

When an event is recognised as an insured event

Conditions for a claim

Every claim is assessed against the circumstances of the accident, the technical investigation report and the documents submitted.

Accident at an insured facility

Destruction of a structure or technical device, an uncontrolled explosion or a release of hazardous substances at a facility listed in the annex to the contract.

Harm caused to other persons

People, property or the environment were affected, and the injured parties are not in an employment relationship with the policyholder.

Liability is confirmed

The obligation to compensate is established by a court decision or by a tripartite agreement in out-of-court settlement with the insurer's consent.

From the accident to the payment to the injured

The contract covers the operator's obligation to compensate harm to the life, health and property of other persons and to the environment in an accident at the facility.

Other persons are residents, neighbouring businesses and the state. The policyholder's own employees are not among them: harm at work is covered by employer liability insurance.

Accident at the facility

Destruction of a structure or technical device, an uncontrolled explosion or a release of hazardous substances during the insurance period.

Other persons demand compensation — through court or out of court with the insurer's consent.

Investigation and assessment

The causes are established by the technical investigation report; the amount of harm is confirmed by documents from competent authorities and experts.

Report and payment

The parties sign the insured event report, after which compensation is paid directly to the injured.

Which facilities count as hazardous production facilities

An enterprise, workshop, section, site or other production facility with at least one hazard feature from article 4 of the Law on Industrial Safety of Hazardous Production Facilities:

hazardous substances are used, produced, stored or destroyed: explosive and fire-hazardous, harmful substances of classes I–III, explosives, hazardous waste

equipment is used that operates under pressure above 0.07 MPa or at a temperature above the boiling point of the working fluid

03

stationary lifting mechanisms, escalators, ropeways or funiculars are used

04

melts of ferrous and non-ferrous metals and their alloys are produced

05

mining, extraction and processing of minerals or underground work are carried out

The facility is entered into the state register maintained by the Committee for Industrial, Radiation and Nuclear Safety. The facility type is set during identification.

How much the policy costs

The premium is a percentage of the sum insured, which the law sets by facility type. The annual tariff is 0.05–0.13%; the exact rate depends on the process and the degree of risk.

Type I ≈ 103 bn UZS sum insured — 250,000 BCV premium from 51.5 mln UZS a year

High-hazard facilities: hazardous substances are used, produced, stored or transported in quantities at or above the threshold limits.

Type II ≈ 20.6 bn UZS sum insured — 50,000 BCV premium from 10.3 mln UZS a year

Facilities with the same features but with hazardous substances below the threshold limits set in the annex to the Regulation.

Type III ≈ 4.12 bn UZS sum insured — 10,000 BCV premium from 2 mln UZS a year

Other facilities with hazard features: pressure equipment, lifting structures, metal melts, mining operations.

Sums insured are set in base calculation values and recalculated using the BCV effective on the date the contract is signed. Amounts in UZS are shown at the current BCV of 412,000 UZS.

What is covered

harm to the life and health of people injured in an accident at the facility

damage to the property of other persons — neighbouring businesses, homes, vehicles

harm to the environment: pollution of land, subsoil, surface water and groundwater

costs incurred by the policyholder to reduce the loss from the accident

Compensation is paid within the sum insured. Loss mitigation costs may exceed it by no more than 20%.

What is not covered

harm to the policyholder's employees while performing their duties — that is the subject of employer liability insurance, not this policy

moral damage and lost profit, as well as penalties, fines and late-payment interest under contracts

damage to the policyholder's own property, including leased property and property accepted for storage

wilful acts, war, terrorism, civil unrest, strikes and circumstances unrelated to operating the facility

Deadlines that matter

72 hours the deadline for the first notice of the event to the insurer
5 working days for the written notice stating the causes and circumstances of the accident
15 days for the decision to pay or a reasoned refusal after the request
10 working days to pay compensation from the date the insured event report is signed

The policyholder's obligations under the contract

Comply with industrial safety requirements, maintain production control, carry out equipment expertise on time and admit only certified personnel. Report an accident within three working days. How the event is assessed depends on this.

Documents and details

The contract is concluded on the basis of an application form. To assess the risk, a specialist will confirm the composition of the facilities and their condition.

Facility identification

The conclusion on identification of the hazardous production facility or its consolidated registration sheet.

State register entry

A copy of the certificate of registration of the facility in the state register of hazardous facilities.

Orders of supervisory authorities

Valid orders issued by the authorised industrial safety authorities, if any.

Type and location of facilities

The full name of each facility, its type and address — the minimum sum insured depends on this.

Hazardous substances and equipment

Types and volumes of hazardous substances, the technical devices and structures used at the facility.

Policyholder details

The name, address and bank details of the operating organisation and a contact person.

The contract is concluded on the basis of the policyholder's written application containing accurate details of the facilities.

Fill in the application form and attach the facility identification and registration documents.

Agreeing the terms

We determine the type of each facility, its sum insured, the insurance period and the premium.

Premium payment

The premium is paid in a lump sum within three working days of signing the contract, or by an instalment schedule.

Insurance policy

The policy is issued within three working days after the premium reaches the insurer's account.
